Can you sell a house with black mold?
I think there is a law on guaranteeing habitibility in the state of California. Can black mold violating this law? I am not selling the house … I am the potential buyer! This is a foreclosure and the bank sent several pages of disclosures saying they are not aware of the problem. However, after I signed out of this, I realize that it had visible water damage, so I had a piece Gypsum wall to the test. Unfortunately, the results show that there are high levels of toxic mold. The bank has more or less said that the house is sold as is, and they will not fix anything. Had to remedy the mold problem, or it is clear, as it has sold "as is"?
It is sold as is. Unless the mold poses a health problem to others in the neighborhood, the bank does not have to do anything. Warranty of Habitability has to do with leasing to others. No need to fix the black mold, but you can negotiate with them. Get a mold removal estimate.
