toxic mold claims
Fired while on medical leave?

more than 4 months ago just after I became ill and had been seen in a room Emergency said I was suffering from exposure to toxic mold, which in my workplace. My company, the owner and employees all knew had leaks, but when the roof exposed black mold growing opened everywhere on the ceiling. After months of tests and specialist visits I am still not well and doctors are keeping me out of work. I just got a notice from my company was being terminated because I have not yet returned to work. Yes, I filed a workmans comp claim and which is still pending. Is this legal in the state of Washington?

unless you have a contact who are employed "At will "….. if you are employed in a position then the conclusion is legal … termination will not affect the remuneration of workers claim except when it comes time to resolve. I will not work on the job when injured can be used as a factor in determining multiplier solution if a permanent partial disability. what no one else knew or did not know, did or did not do (on the mold) is relevant in determining WC, but not in the question of its termination. for assistance with your claim WC: http://www.lni.wa.gov/ Washington State Department of Labor and Industries
