Can I act as my own attorney to sue sellers of house w/problems?
Sellers marked NO on real estate disclosure. 6 mos. later, we find severe toxic mold and multiple problems. California real estate agents no help. Insurance does not cover mold. Funds are tapped out. I cannot afford an attorney. Can anyone advise? Can I serve legal papers to sellers who moved out of state? We sent a cert. letter explaining the problems and asked for response within 10 days to avoid court action. Have not heard back (one week). Any honest help and advise would be appreciated.
You can, but you won’t win.
This is hard. Very hard. Find a lawyer. Even a hungry new admittee working on a contingency fee would be better than trying to do this yourself.
You will be spinning your wheels just trying to draw up a solid complaint and serving on the out of state defendants. Then you will face the legal expertise of two lawyers, one for the sellers, one for the real estate agent.
Keep calling lawyers.
