
Do I have the right to cancel my current contract and ask to be moved to another apt for mold on the walls?
There is mold on the wall of my apartment campus-off caused by leaking A / C unit. I have tested it for my own peace of mind and discovered that it is formed by Aspergillus, Cladosporium, Acremonium, Penicillium, Rhizopus, and Ulocladium. I have been dealing with headaches, congestion and sore throat the past few months, and my apartment smells very musty and moldy now. Because of this, and since the manager has been very slow to get it resolved, I was thinking of asking to be moved elsewhere. I know I'm apparently not about something really serious as Stachybotrys (black mold toxic), but there may be this type of molds present still give me the right to cancel the rest of my lease and ask to be moved elsewhere, or that the manager will most likely not take it seriously? let know of the problem on May 20. It has been almost two months and nothing has been resolved. I think I did a lot of time to take care of it!
In fact, you can break your lease. However, before you can do this, you must notify the owner of this matter. This notification must be in writing and sent by registered mail so it is proof that this was received by the owner. You must give the landlord a reasonable amount of time to respond and remedy the problem. If after a reasonable amount of time that has passed, I think it is well within his rights to break this contract. I like to do an online search for the owner of State / tenant laws. You can also check your local rental Arbitration. They can give good advice.
